Suggested Real Estate contract amendments for requested mitigation systems and for Radon tests.

If the NEHA-NRPP laboratory radon test measures average radon gas levels at or above the EPA action level of 4.0 pCi/l, then the house is to be mitigated at the expense of _______ and will be installed by a NEHA-NRPP Certified Mitigation Company that meets the following criteria:
Will guarantee the radon annual levels no to exceed 3.9 pCi/l for the life time of the system as long as it is maintained and operated, will include a clearance test and a year long test device using a NEHA-NRPP Certified Laboratory, will use foam core 4" PVC pipe if installing an active soil depressurization system, will adhere to the EPA Radon Mitigation Standards (EPA 402-R-94-009), and will provide proof of liability insurance with a current Certificate of Liability Insurance for an amount of $3,000,000.00

If a radon test is to be performed after closing also include:
Within a 30 day period after closing a radon test will be performed at the expense of _______ . The test device(s) used will be from a NEHA-NRPP certified radon laboratory and will follow the Protocols for Radon and Radon Decay Product Measurements in Homes (EPA 4025-R-93-003). Consider the cost of mitigation system to be escrowed at closing, to be released upon the results of the radon test.
